Patient's leg amputated due to fault of doctor in West Kazakhstan region: Surgeon avoids prison term

Uralsk. November 21. KazTAG – A patient whose leg was amputated due to fault of a surgeon in West Kazakhstan region has forgiven the doctor, said the press service of the regional court.
"The defendant was released on the basis of Part 1 of Article 68 of the Criminal Code in connection with reconciliation with the victim from criminal liability for committing a criminal offense under Part 2 of Article 317 of the Criminal Code, the criminal case was terminated," said the report.
On October 25, 2023, the victim received an industrial injury and was taken to hospital, treated with antiseptics, necrotic tissue, the edges of the wound were sutured without cutting, and the blood was drained without ensuring the outflow of purulent exudate, without draining the sutured wound. According to the data, as a result of which edema fluid accumulated in the wound, which led to tissue compression and created conditions for infection.
According to the information, on November 10, 2024, due to the negligence of the surgeon, the injured right leg was amputated.
During the consideration of the case, the victim stated that the damage caused to him was compensated by the defendant, reconciled through mediation, forgave him and filed an application to terminate the criminal case.
The defendant did not object to the termination of the criminal case on this basis, explaining that he reconciled with the victim through mediation, and that the consequences of termination are clear to him.
